Statement retreat embarrasses CID BDR carnage case

Bangladesh Rifles (BDR) jawans, who made confessional statements in the Peelkhana carnage case, continued filing applications with the courts to retreat their statements leaving the Criminal Investigation Department (CID) in an embarrassing situation.

The members of the paramilitary troop, in their applications, are bringing widespread allegations of torture and repression against the investigating agency members for what they claim making confessional statements, court sources said.

The law enforces have so far arrested 2,166 border guards and 32 civilians in the case filed with the Lalbagh police in connection with the February 25-26, 2009 carnage inside the BDR headquarters at Peelkhana in which at least 57 army officials and 18 others were killed.

Of the arrested border guards, 2,144 were taken on remand and 537 jawans gave confessional statements before the courts.

Some 130 BDR men have so far filed applications with the courts to retreat their confessional statements, court sources said yesterday.

Appeals for retreating statements by the accused jawans on such a sensitive issue and their allegations of torture and repression against the CID investigators have caused an embarrassing situation for the investigators as they might, once the courts accept the BDR jawans appeals, need to stand before the court.

Talking to The Independent Advocate Moshrraf Hossain Kazol, who is assisting the BDR to prepare the charge sheet in the case, said, "Over 500 BDR men made confessional statements. Of them, over 130 jawans filed petitions to retreat their statements."

The lawyer also claimed that the applications would not affect investigation into the case or the trial process.

The CID had already found involvement of around 800 to 1,000 BDR men in the Peelkhana carnage.

After verifying confessional statements made by the BDR border troops, examining evidences, video footages, statements made by the family members' of the army officers and cross examining information extracted during interrogation, the investigators have confirmed their involvement.

Over 200 CID personnel from sub-inspectors to assistant superintendents (ASP) of the police are now investigating the carnage case led by senior ASP Abdul Kahar Akand as the investigation officer (IO). The team members include at least 25 ASPs.

On March 1 last year, the case was filed against over 1,000 BDR men, including deputy assistant director (DAD) Touhidul Alam with the Lalbagh police for their alleged involvement in the mass killing, looting, firing gunshots and exploding grenades.

The case was later shifted to the New Market police station.

The CID men has recorded statements of 6,250 people, including 125 family members of the army officers, 430 dwellers of areas adjacent to the Peelkhana headquarters, 310 BDR staff, 25 firemen and 700 law enforcers, including police, army and others, who worked inside the BDR headquarters after the carnage.
